As reported in our annual Regulatory Update, in April, the Employee Benefits Security Administration (EBSA) outlined guiding principles and enforcement priorities for the agency. The first was to ‘prioritize investigations into the most egregious conduct or significant harm.’
Staying true to these principles, the government has obtained a guilty plea from the CEO of a benefits administration firm who admitted to embezzling over $8 million from an ERISA-covered benefits plan. James Vincent Campbell, aged 49, is the CEO and founder of Axim Fringe Solutions Group, a third-party administration (TPA) company that primarily focuses on processing benefits contributions for employees of federal contractors.
Axim’s role as a TPA was to collect funds to cover employee health premiums and 401(k) contributions. Before forwarding the funds to health insurers and retirement accounts, Axim pooled the funds in a master trust account. Over a nine-year period, Campbell completed 135 unauthorized withdrawals totaling nearly $2.5 million. In addition to embezzling contributions, he began charging clients up to five times Axim’s contracted fee, unlawfully converting a total of over $8 million. The stolen funds were used to support a lavish lifestyle, including big game hunting trips, jewelry, gambling, and payments to his girlfriend. Campbell pleaded guilty to a single count of theft from an ERISA plan and faces a maximum sentence of five years.
The EBSA investigated the case, and the new head of the agency, Daniel Aronowitz, stated that the ‘EBSA will continue to pursue those who try to steal pension assets as part of its efforts to prevent and fight fraud committed on both pension and healthcare plans.’
